1. Agreement

By accessing or using digicolr.com (the "Site") and any services provided by Digicolr ("Digicolr", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site or our services.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify Digicolr immediately at digicolrcom@gmail.com if you suspect unauthorized access or use.

3. Digital Products & Licensing

Digicolr offers digital files, templates, mockups, and SaaS tools. Each product includes a license (commercial or personal) that governs permitted uses. Unless the license explicitly allows redistribution, resale, or sharing of source files, those actions are prohibited.

4. Subscriptions & Lifetime Access

We offer subscription plans (auto-renewing) and lifetime access purchases. Subscriptions are billed on the selected recurring schedule until canceled. Cancelling a subscription prevents future charges but does not necessarily result in a refund for the current billing period. Lifetime access grants access to the specified products or features as described at the time of sale.

5. Payment & Billing

Payments are processed by third-party payment processors such as Stripe and PayPal. By purchasing, you authorize Digicolr to charge your selected payment method. Digicolr does not store full credit card numbers or CVV codes.

6. Refunds & Cancellation

Our refund policy is available separately at the Refund Policy page. In short, Digicolr provides a 14-day refund window for eligible first-time purchases subject to a fair-use limitation. Renewals are generally non-refundable. Visit the Refund Policy page for full details.

7. User Conduct & Prohibited Uses

• Do not use Digicolr products or services for unlawful purposes or to infringe third-party rights.
• Do not attempt to reverse-engineer, scrape, or extract proprietary content, algorithms, or data from our services.
• Do not misuse downloads in violation of their license terms (e.g., representing someone else's work as your own when license restricts).

8. Intellectual Property

All content, trademarks, logos, and materials on the Site are the property of Digicolr or its licensors, and are protected by international copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers ownership of Digicolr intellectual property to you.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Digicolr's total liability to you for any loss or damage arising from or related to these Terms or the use of the Site will not exceed the total amount you paid to Digicolr during the 12 months preceding the claim. Digicolr is not liable for indirect, incidental, special, consequential, or punitive damages.

10. Indemnification

You agree to indemnify, defend, and hold harmless Digicolr and its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of: (a) your breach of these Terms; (b) your violation of applicable law; or (c) your use of the Site or products.

11. Termination

We may suspend or terminate your access to the Site or services for violations of these Terms, suspected fraud, or illegal activity. Termination does not relieve you of obligations incurred prior to termination.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law rules. If you prefer a different jurisdiction, contact Digicolr prior to purchase to discuss alternative terms.

13. Changes to Terms

Digicolr may revise these Terms from time to time. Updated Terms will be posted on this page with a new "Last updated" date. Continued use of the Site following changes constitutes your acceptance of the revised Terms.

Our Site may contain links to third-party websites and services. Digicolr is not responsible for the content or practices of third-party sites. Your use of third-party services is governed by their terms and privacy policies.
